Terms and Conditions

1. Agreement to these terms

By downloading, accessing or using Pushup Social (the "app") you agree to these Terms and Conditions. If you do not agree, please do not use the app. If you use the app through the Apple App Store, Apple's Standard End User Licence Agreement also applies, and where it conflicts with these terms, the stricter provision applies.

2. Who we are

Pushup Social is operated by Josh Mustafa, a sole trader based in the United Kingdom ("we", "us", "our"). You can contact us at joshmus7@msn.com.

3. Eligibility

You must be at least 13 years old to use Pushup Social. By using the app you confirm that you are old enough and able to enter into this agreement. If you are under the age of majority where you live, you should review these terms with a parent or guardian.

4. The service

Pushup Social is a social fitness app for logging pushups, competing on leaderboards, building streaks with friends and teams, and optionally earning back screen time by working out. Some features are free and some require a paid Pushup Pro subscription. We may add, change or remove features over time.

5. Your account

• You are responsible for the information you provide and for keeping your login details secure.
• You are responsible for activity that happens under your account.
• You must give accurate information and keep it up to date.
• Do not impersonate anyone or create an account for someone else without permission.

6. Subscriptions and payments

Pushup Pro is an auto-renewing subscription sold through the Apple App Store. It is available on weekly, monthly and yearly plans, and some plans include a free trial (for example a 3-day trial on the weekly plan and a 7-day trial on the monthly plan). Current prices and trial lengths are shown in the app before you buy.

• Payment is charged to your Apple account at confirmation of purchase.
• Your subscription renews automatically for the same period unless you turn off auto-renew at least 24 hours before the current period ends.
• You can manage or cancel your subscription any time in your Apple App Store account settings. Deleting the app does not cancel a subscription.
• If you start a paid subscription during a free trial, any unused portion of the trial is forfeited, in line with Apple's rules.
• Payments, billing and refunds are handled by Apple under Apple's terms. We do not process or store your payment details.
• We may change prices or plans; any change will apply from your next billing period and, where required, we will let you know in advance.

7. Referral programme

We may offer a referral programme (for example, one free month of Pushup Pro for every three friends who join and become active using your invite link). Rewards are discretionary, may have conditions, and we may change, pause or withdraw the programme, or withhold rewards, if we reasonably believe it is being misused.

8. Your content and conduct

You keep ownership of the content you create in the app, such as your posts, comments, team messages and profile. By posting it, you give us a non-exclusive, worldwide, royalty-free licence to host, store, display and share that content as needed to operate the app and its features (for example showing your set on your friends' feeds).

There is no tolerance for objectionable content or abusive behaviour. You must not post content that is unlawful, harassing, hateful, threatening, obscene or otherwise objectionable, and you must not abuse other people. We provide tools to report content and block users, we review reports, and we may remove content and suspend or terminate accounts that breach these terms.

9. Acceptable use

You agree not to:

• cheat, fake reps or otherwise manipulate counts, streaks or leaderboards;
• harass, bully, threaten or impersonate other people;
• post illegal or objectionable content, or infringe anyone's rights;
• attempt to access other users' accounts or data;
• reverse engineer, scrape, disrupt, overload or interfere with the app or its systems;
• use the app for any unlawful purpose.

11. Screen time and app blocking

The screen-time feature uses Apple's Screen Time controls to help you block chosen apps until you earn time back with reps. It is a self-motivation tool provided on a best-effort basis. It is not a security, parental-control or content-filtering product, and we do not guarantee that it will block any particular app or content in all circumstances.

12. Our intellectual property

The app, its name, logo, design, software and content (other than your own content) belong to us or our licensors. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the app for your own personal, non-commercial use. You may not copy, modify, distribute, sell or create derivative works from it except as allowed by law.

13. Third-party services

The app relies on third-party services (such as Apple, and the providers listed in our Privacy Policy). Your use of those services may be subject to their own terms, and we are not responsible for them.

14. Termination

You can stop using the app and delete your account at any time from within the app. We may suspend or terminate your access if you breach these terms, if required by law, or to protect the app or its users. Terms that by their nature should survive termination (such as intellectual property, disclaimers and limitation of liability) will continue to apply.

15. Disclaimers

The app is provided "as is" and "as available". To the extent permitted by law, we do not guarantee that it will be uninterrupted, error-free, or that it will meet your expectations. We are not responsible for content posted by other users.

16. Limitation of liability

To the extent permitted by law, we will not be liable for any indirect or consequential loss, or for loss of data, profits or goodwill, arising from your use of the app. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded under the law of England and Wales. If you are a consumer, your statutory rights are not affected.

17. Changes to these terms

We may update these terms from time to time. When we make material changes we will update the date at the top and, where appropriate, let you know in the app. Continuing to use the app after changes take effect means you accept the updated terms.

18. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, except that if you are a consumer you may also be entitled to bring proceedings in your own country of residence.
